Modifications to asbestos legislation

The Control of Asbestos Regulations 2006 (Car 2006) came into force on 13th November 2006, revoking the prior Control of Asbestos at Work Regulations 2002, Asbestos (Licensing) Regulations 1983, and Asbestos (Prohibition) Regulations 1992. The new regulations were introduced to be able to implement the new requirements under the European Asbestos Worker Directive and to create other changes to the asbestos legislative framework.

The main modifications introduced by Vehicle 2006, are these relating to exposure limits and to asbestos licensing.

Exposure limits:

There is now a single control limit of 0.1 f/cm³ for all types of asbestos, including white (chrysotile) asbestos along with a Short Phrase Exposure Limit (STEL) of 0.6 f/cm³ measured more than a ten-minute time period.

The manage limit is the level of asbestos fibres in the air, so far as is reasonably practicable, that should not be exceeded. One person’s exposure should by no means go over this limit when measured more than a four-hour period.

The Action Level, as used in the Control of Asbestos Regulations 2002, no longer exists below the new framework.

There's now a requirement for respiratory protective gear to become used to cut back exposure to as low as is reasonably practicable, even when the danger assessment shows that the manage limit is not anticipated to become exceeded. back to leading

Licensing:

Under previous legislation, a licence from the HSE was required for function on asbestos insulation, asbestos insulation board and asbestos coatings. Nevertheless, the Manage of Asbestos Regulations 2006 have significantly changed this approach.

Most work on asbestos will still require to be carried out by a licensed contractor, but this requirement will probably be determined by risk. Probably the most substantial alter towards the regulations is associated with function with asbestos decorative coatings. In most instances, the removal of decorative coatings will no longer need to be undertaken by an HSE-licensed contractor.

Vehicle 2006 moves away from licensing specific asbestos supplies, instead focussing on a risk-based method. back to top

Training

Regulation 10 of Car 2006 addresses the issue of info, instruction and coaching, and splits the training specifications into licensed, non-licensed and awareness coaching.

The Authorized Code of Practice which accompanies Vehicle 2006, states that asbestos awareness coaching should be provided for all those persons liable to disturb asbestos supplies while carrying out their everyday work, or may influence how such function is carried out, like maintenance employees, electricians, plumbers, and so on.
